I am a real estate attorney and I am also a licensed real estate broker who has been involved in hundreds of real estate transactions, ranging from simple to routine to extremely difficult and everywhere in between. In non FSBO situations when I work as listing broker or buyer’s broker, I do not charge extra for my legal counsel. I also assist other agents or brokers, by assisting with the legal paperwork, title issues, short sales, doing escrow setup for complex transactions or sometimes by coming into the deal as a co-broker, representing buyer or seller both as attorney and broker, receiving payment usually at closing. I also assist sellers and buyers selling through For Sale by Owner and saving them thousands of dollars. Seller financing is also something I am able to assist with. Each seller financed transaction is different. An attorney should be involved – to get the transaction set up right and into escrow and closed and to make sure moving forward there are not any issues.

In a FSBO transaction you as the owner handle any repairs or inspections needed prior to putting the house on the market, the marketing and staging of your home, coordinating showings of your home with potential buyers, the holding of any open houses, the creation of brochures, professional pictures, which websites you list it on, etc. Be careful that if you list your home on any MLS listing service (you will get offers from $99 on up to do so), you are then contractually obligated to offer and pay at closing a commission to the buyer’s agent of typically 3%.
