Strategic Default Foreclosure Service

Strategic Default Foreclosure Service

What is a Strategic Default?

Strategic default, also known as voluntary foreclosure, is when the borrower decides to stop paying a mortgage even though they can still afford the payment. For many people who are upside down on their mortgage, the decision to strategically default is one that is difficult but, often times, the first step to financial freedom. It is also referred to as “walking away.”

The Wall Street Journal’s Real Time Economics reported that researchers have found that homeowners start to default once their negative equity passes 10% of the home’s value. After that, they “walk away massively” after decreases of 15%. Lenders know this too and it affects the modifications they give or if they find you eligible. They know that even if they grant a modification that if the home is upside down the borrowers default rate sky rockets and they are very likely in the  future to stop paying even the modified rate.

If you choose after consulting with us regarding your options and your exposure and liability should you choose we are here to help you walk through the process.  We advise you on if this is a safe option for you and then we review the notices that you receive, answer your questions and follow up with your lender regarding the foreclosure.  Sometimes our clients want to stay in their home for as long as we are able and so we discuss how we can assist with that, or sometimes our clients want to speed up the foreclosure to get it done and over with as soon as possible in order for tax purposes or just to close that chapter.
