Funding Your Trust

Sacramento Living Trust

Once your living trust has been drafted funding is critically important to the success of your estate plan and living trust.  A lot of attorneys don’t offer an option to help their clients fund their trust, but for our clients who would prefer that we handle funding their trust we are able to do so.  If you would like to take care of it yourself we offer a helpful and thorough living trust funding guide.  No matter which option you choose we always take care of having your real property deeds recorded with the county.  We verify this recording and send you the copies once they are returned to our office so we make sure that your important real property assets ARE in your living trust name.

The Role of Funding

Every trust is created to accomplish certain objectives. Some of those objectives are intended to be accomplished during a grantor’s lifetime, while others are intended to be accomplished only after a grantor’s death. Whatever your objectives might be, it is clear that they cannot be achieved with a revocable living trust unless the trust is properly funded. Funding a trust is critical to achieving the objectives of the trust.

When we say that funding a trust is critical to achieving the objectives of the trust, we do not mean to suggest that you must transfer all of your property to your revocable living trust at the very instant you sign the trust instrument.  So, there is a natural reluctance to transferring property to a revocable living trust. If done properly, however, the process of funding your living trust can be done painlessly and without any significant impact on your current lifestyle.

Please see our funding guide for complete information on funding methods for different assets.

We have a “funding plan” option to ensure your assets are protected throughout your lifetime and none of your assets will end up going through a long, expensive court process (“probate”) or being lost to the state because they were missed after your death.
